Felony Classes and Sentencing Ranges

Colorado categorizes felonies into six classes, each with specific sentencing guidelines:

Extraordinary risk felonies, such as aggravated robbery or child abuse, carry enhanced sentences. For instance, a Class 3 extraordinary risk felony can result in a maximum sentence of 16 years, while a Class 4 extraordinary risk felony can lead to up to 8 years in prison.

Crimes of Violence and Mandatory Minimums

Certain offenses are classified as “crimes of violence,” which include:

  • Murder
  • Assault
  • Kidnapping
  • Sexual offenses
  • Aggravated robbery
  • First-degree arson
  • First-degree burglary

Convictions for crimes of violence impose mandatory minimum sentences:

​​Additionally, if a dangerous or semiautomatic assault weapon was involved, five years are added to the sentence.

Habitual Offender Sentencing

Under Colorado’s habitual offender statute, individuals convicted of a serious felony offense for the third time can be sentenced to life imprisonment.

This applies to:

  • Class 1 felonies
  • Class 2 felonies
  • Level 1 drug felonies
  • Class 3 felonies that are crimes of violence

​Alternatively, a third conviction for any Class 1–5 felony or Level 1–3 drug felony within 10 years results in a sentence three times the maximum presumptive range for the current offense .

Special Drug Offender Sentencing

Individuals convicted of felony drug offenses may be designated as “special offenders” if certain aggravating factors exist, such as:

  • Previous convictions for manufacturing, selling, or distributing controlled substances
  • Committing offenses as part of a pattern of drug trafficking
  • Using a deadly weapon during the commission of the offense

Special offenders face enhanced sentencing, with terms ranging from 8 to 48 years in prison.

​Alternative Sentencing Options

Colorado law provides several alternatives to traditional prison sentences, including:

  • Deferred prosecution and sentencing: Charges are held in abeyance while the defendant completes treatment or education programs. Successful completion may lead to reduced or dismissed charges.
  • Probation: Allows the defendant to remain in the community under supervision, with conditions such as counseling, drug testing, or community service.
  • Community corrections: Residential or non-residential programs that provide supervision and services to offenders.
  • Home detention: Offenders serve their sentence at home with electronic monitoring.
